2. Discipline and Confidential issues
2.1 All relevant personnel involved in the bidding should consciously accept the supervision of relevant competent department and should not disclose the name, number and other information about the potential bidders who had received the bidding documents that are related with the tendering and bidding and might influence fair competition.
2.2 The bidders should not conspire with each other and should not obstruct and exclude other bidders with improper means, or drive up the price, disrupt the bidding market, and destroy the principle of fair competition.
2.3 All parties involved in the tendering and bidding should keep secret about the business and technology secrets in the bidding document; any offenders should undertake corresponding responsibilities in law for the resulting consequences.
3. Bidder should Know
3.1 The project is EPCC project. The general contractor performs management responsibility in terms of project quality, HSE, progress, and investment control as a representative of the proprietor PMT. The bid winner should accept the site supervision from the general contractor, as well as the supervision from the proprietor PMT.
3.2 The bidder should make an on-the-spot inspection to the construction field and ambient environment, so as to obtain all the information required to compile the bidding document and sign the contract; the tenderee should provide necessary assistance and coordination to the site inspection of the bidders. However, the bidder and its representative should be responsible for the personal injury and loss or damage of property caused by the site inspection and should also be responsible for any other expenses of loss and damage; the tenderee should have no responsibility for the these losses. The expense of site inspection should be assumed by the bidders themselves.
3.3 All the bidders participating in the invitation for bid are considered to have fully recognized and understood any influencing issues and difficulties concerning the project.4. Bidding Requirement
4.1 The project does not accept two or more than two bidders forming a combo to participate in the bidding as one bidder.
4.2 Where the bidding principal of the bidder does not have the qualification as legal representative, the bidder should submit authorization signed and stamped by the legal representative of the bidder. See Annex VI for the format of authorization.
4.3 In case the bidder fails to provide all the information according to the requirements in the bidding document, or the tender document fails to make substantial respond to various aspects of the bidding requirements, the risk should be borne by the bidders; tender document with no substantial respond to the requirements in the bidding document will be rejected and the resulting consequences should be assumed by the bidder.
